1. Scope
This policy applies to tenacy.ng and to information Tenacy Technologies ("Tenacy", "we", "us") handles when you contact us or work with us. Each Tenacy product, such as Librarie, may have its own privacy notice that applies in addition to this one. Where we build or host a platform for a client, that client is usually the data controller and its own privacy policy applies.
We process personal data in line with the Nigeria Data Protection Act 2023 (NDPA) and, where applicable, other data protection laws such as the GDPR.
2. Information we collect
Information you give us
- Contact details such as your name, email address, phone number and company when you email us or use our contact form.
- Project information, budget ranges and any files you share with us.
- Job application details such as your CV, portfolio and work history.
Information collected automatically
- Basic technical data such as IP address, browser type, device type and pages visited, collected through server logs and privacy-focused analytics.
- Security data used to detect and block abuse, such as request rates and bot signals provided by our hosting provider.
We do not knowingly collect sensitive personal data through this website.
3. How we use your information
- To respond to enquiries and provide quotes.
- To deliver services and products you have engaged us for.
- To assess job applications.
- To operate, secure and improve our websites.
- To meet legal, accounting and regulatory obligations.
We do not sell your personal data, and we do not use it for third-party advertising.
4. Lawful basis
We rely on one or more of the following bases under the NDPA:
- Consent, for example when you submit an enquiry.
- Contract, where processing is needed to deliver services to you.
- Legal obligation, for tax, accounting and regulatory requirements.
- Legitimate interests, such as securing our websites, where those interests are not overridden by your rights.
5. Sharing
We share personal data only with service providers who help us operate, under contracts that require them to protect it. These include:
- Hosting and content delivery providers, such as Cloudflare.
- Email and productivity providers.
- Payment processors, where you pay for a product or service.
- Professional advisers, such as accountants and lawyers.
We may also disclose information where required by law or to protect the rights, safety or property of Tenacy or others.
6. International transfers
Some of our providers process data outside Nigeria. Where this happens, we rely on safeguards permitted by the NDPA, such as adequacy, contractual protections or your consent.
7. Retention
We keep personal data only as long as needed for the purposes above. Enquiries that do not lead to a project are deleted within 24 months. Client records are kept for the duration of the relationship and as required for legal and tax purposes, typically six years. Unsuccessful job applications are deleted within 12 months unless you ask us to keep them longer.
8. Security
We use encryption in transit, access controls, the principle of least privilege and regular updates to protect personal data. No system is perfectly secure; if we become aware of a breach affecting your data, we will notify you and the Nigeria Data Protection Commission as required by law. See our security page for how to report a vulnerability.
9. Your rights
Subject to the law, you have the right to:
- Access the personal data we hold about you.
- Correct inaccurate or incomplete data.
- Request deletion of your data.
- Restrict or object to certain processing.
- Receive your data in a portable format.
- Withdraw consent at any time, without affecting earlier processing.
- Lodge a complaint with the Nigeria Data Protection Commission.
To exercise these rights, email [email protected]. We respond within 30 days.
10. Cookies and local storage
This website does not use advertising or tracking cookies. We store your light or dark theme preference in your browser's local storage so it is remembered between visits. Our hosting provider may set strictly necessary cookies for security and bot protection. Any analytics we use are privacy-focused and do not track you across sites.
11. Children
This website is not directed at children under 13, and we do not knowingly collect their personal data.
